2022 Participant Waiver of Liability
BY SIGNING THIS DOCUMENT, THE UNDERSIGNED INDIVIDUALS GIVE UP ALL RIGHTS TO LITIGATION AND OTHER CLAIMS:
I hereby agree to this waiver of liability and release of claims and I hereby release and discharge the Edmonton Dragon Boat Racing Club, also known as EDBRC, its officers, directors, coaches, members, volunteers, agents, and employees, contractors (herein referred to collectively as “personnel”), the City of Edmonton (herein referred to as CoE) and The Edmonton Public School Board (herein referred to as EPSB) from all claims, demands, actions, judgments, and executions which the undersigned’s heirs, successors, executors, administrators, representatives or assigns may have, or claim to have, for any and or all personal injuries, known and unknown, and injuries to property, real or personal, caused by, or arising, out of the participation in the activity of site set-up and/or tear down (hereafter “operations”), participating in the sport of dragon boat paddling, use of any club equipment /facilities, on water practices, and/or racing.
I acknowledge, agree and understand there are inherent risks involved with dragon boat paddling and EDBRC operations, and I am aware of the nature of these risks. Notwithstanding these risks, I hereby waive any and all rights, claims, prospective causes or causes of action etc. as heretofore set out. I hereby assume any and all risk associated with my participation in this sporting activity and use of club equipment, and or EDBRC operations. I understand that paddling on lakes, reservoirs and rivers involve certain dangers, not all of which can be listed herein. Among the more obvious and frequent are:
Exposure to variable extremes in weather that may cause injury due to heat, cold, lightning and which may prevent or force route and itinerary changes.
Contact with and possible immersion in cold water for undetermined periods, leading to hypothermia and possible suffocation.
Exposure to boat capsizing and sinking, trees, rocks, bridge abutments, log jams, rope entanglement, current patterns and other possible sources of “in water” injury and entrapment.
Unfamiliar terrain and routes where dragon boats could become separated from the party.
Transport by public or private motor vehicle.
Travel in remote locations with poor communications and inability to get rescue or medical assistance easily or quickly.
Access, ingress and egress to the docks, on the docks, and boating equipment.
Access, ingress and egress to the storage facilities or buildings of the Edmonton Dragon Boat Racing Club.
I am not relying on any oral or written statements, if any, made by the Edmonton Dragon Boat Racing Club’s personnel, whether in brochure, advertisements, signage or in individual conversations, to lead to me to become involved in dragon boat paddling and/or EDBRC operations on any basis other than my assumption of the risks involved. I accept all of the risks and the possibility of death, personal injury, property damage and/or loss resulting from my involvement with practice, use of club equipment, racing events and EDBRC operations. I confirm the Edmonton Dragon Boat Racing Club’s, personnel have been available to fully explain the various hazards and risks associated with the Edmonton Dragon Boat Racing Club’s activities and those risks associated with the program in which I, my child or charge or organization are involved. I certify that I am physically able, capable and fit to participate in this activity and I have no medical conditions or needs that would prevent me from participating or grossly impede the participation of others. I confirm I am able to swim at least 50 m while wearing a Personal Flotation Device. I confirm I am 18 years of age or older. I have read this waiver of liability and release and I understand all of its terms and conditions. I acknowledge not only is this waiver of liability and release binding on me, but also on my heirs, next of kin, successors, executors, administrators, personal representatives and assigns. I agree even though I may not live in Alberta, the laws of the Province of Alberta and the CoE Edmonton by-laws govern this waiver of liability and release of claims and will be enforceable in any court of law.
TAKE NOTICE the EDBRC is collecting the above information for the purposes, including but not limited to EDBRC updates, practice schedule changes, news and event information, and official notices.
